Should prisoners have rights what rights should they have?
All prisoners shall be treated with the respect due to their inherent dignity and value as human beings. There shall be no discrimination on the grounds of race, colour, sex, language, religion, political or other opinion, national or social origin, property, birth or other status.
The Rights of Prisoners: Overview
Prisoners also enjoy First Amendment protections, including the right to practice one's religion; the right to voice concerns over prison conditions; the right to access the courts to air complaints; and other aspects of free speech.
The ACLU's National Prison Project fights to protect the Constitution's guarantee that individuals who are incarcerated retain basic rights, including the right to free speech, the freedom to practice their religion, and the right to access the courts and counsel. In Turner v.
COURTS HAVE GRANTED BOTH SENTENCED INMATES AND DETAINEES EXPANDED RIGHTS TO RELIGIOUS ASSEMBLY AND SPEECH - OTHER FIRST AMENDMENT RIGHTS DESERVE EQUAL PROTECTION.
People who were incarcerated for felony convictions regain their voting rights immediately after their release, while people who have been convicted of election offenses must complete any terms of probation and parole. Pretrial detention, misdemeanors, probation, and parole do not restrict your voting rights.
Inmates lose their right to vote, their right to privacy, and even some of their First Amendment rights. Over the years, the Supreme Court has struggled to arrive at a consistent standard for the restriction of free speech in prisons, with some questions still unanswered today.
Prisons have four major purposes. These purposes are retribution, incapacitation, deterrence and rehabilitation. Retribution means punishment for crimes against society.
In the landmark case, Cooper v. Pate, 378 U.S. 546 (1964), the United States Supreme Court ruled that prisoners maintain some of their civil rights. In this particular case, the First Amendment right to practice religion and keep religious materials was upheld.
The Supreme Court has made it clear that the First Amendment protects not only the rights of prisoners to send and receive mail, but also the rights of free people to communicate with prisoners.
The First Amendment protects a prisoner's right to practice his or her religion of choice. Congress has acted to reinforce this protection through its passage of the Religious Land Use and Institutionalized Persons Act (RLUIPA).
Do criminals have a right to privacy?
The U.S. Constitution guarantees prisoners' privacy rights, even if it doesn't specifically mention those rights. Despite not explicitly using the term “privacy rights,” the Constitution includes several different protections for those rights.
We hear the good news. Jesus came and proclaim freedom for the prisoners.

You always have Sixth Amendment rights — even in prison. However, these rights might not apply the same way as they do on the outside. For example, on the outside, you have the right to a speedy trial. That does not mean, though, that you have the right to a speedy hearing on in-prison discipline.
Federal inmates may be permitted to attend a funeral outside of prison. Inmates need to apply for a temporary absence to do so, either an escorted temporary absence (ETA) or an unescorted temporary absence (UTA).
All prisoners have the basic rights needed to survive and sustain a reasonable way of life. Most rights are taken away ostensibly so the prison system can maintain order, discipline, and security.
In many prison systems, unwarranted beatings are so common as to be an integral part of prison life. Women prisoners are particularly vulnerable to custodial sexual abuse. In the aftermath of prison riots or escapes, physical abuse is even more predictable, and typically much more severe.
Inmates work in the kitchen, license tag plant or laundry, or perform maintenance or janitorial tasks during the day. Around 3 PM, the inmate usually checks his mail and spends some time on the recreation yard prior to returning to the dining hall for the evening meal at 4 PM.
The experience of imprisonment could deter someone from committing crimes to avoid prison in the future. Prison might provide opportunities for rehabilitation, such as drug and alcohol treatment, education, or counseling.
Time spent in prison can deter offenders from future crime or rehabilitate offenders by providing vocational training or wellness programs. However, incarceration can also lead to recidivism and unemployment due to human capital depreciation, exposure to hardened criminals, or societal and workplace stigma.
Four major goals are usually attributed to the sentencing process: retribution, rehabilitation, deterrence, and incapacitation.
What rights are not given to inmates?
Inmates generally lose their right to privacy in prison. They are not protected from warrantless searches of their person or cell. While inmates do retain their Due Process rights and are free from the intentional deprivation of their property by prison officials, this does not include any form of contraband.
The right of access to the courts is the most important of all prisoners' rights. Civil rights suits filed under Section 1983 of the Civil Rights Act of 1871 have served as the main way for inmates to enforce their constitutional rights.

- On the front end, by reducing the number of people who needlessly enter prison in the first place;
- On the back end, by shrinking the existing prison population by allowing prisoners who have proven they are ready to re-enter society the opportunity to transition out of confinement; and.
Prisoners of war are protected by international humanitarian law as set down in the Third Geneva Convention of 1949.
The eighth amendment provides prisoners with limited rights of protection against cruel and unusual punishment during the course of confinement. These rights extend to the existence of humane living conditions, adequate medical care, and protection from violence by other inmates.
Prisoners' rights are conditional rather than absolute, because they are constrained by the legitimate needs of imprisonment, and bear a strong resemblance to privileges, although unlike conditional rights, privileges can be revoked at any time for any reason.
Differences in Security
However, research suggests that private prisons are actually less safe than public prisons. It's estimated that private prisons have 49% more incidences of violence and assaults on guards than public prisons. Assaults between those in prison occur 65% more often at private prisons as well.
In response to the treatment of prisoners housed in Pelican Bay's Security Housing Units, four inmates (Arturo Castellanos, Sitawa Nantambu Jamaa (Ronnie Dewberry), Todd Ashker, and George Franco) began the Prisoner Human Rights Movement.
Overcrowding, as well as related problems such as lack of privacy, can also cause or exacerbate mental health problems, and increase rates of violence, self-harm and suicide.
